Definitions. In this Agreement, “Access Device” means your Card, PIN, password, online username, challenge questions, and any other security information, code, or device that we make available to access your Account.
“Account Number” means the 14-digit number used to identify your Pivot Card Account.
“Account Owner” means the person who qualified for and opened the Account and owns the funds in the Account.
“Applicable Law” means all applicable local, state, federal, and foreign laws, regulations, ordinances, and statutes, as well as any applicable rules, policies, and procedures established by NACHA or any applicable electronic payment network or card association or network. “ATM” means Automated Teller Machine.
“Available Balance” is the amount of funds available for withdrawal and authorizing transactions, which may be different than your Current Balance. The Available Balance is reduced by 1) the amount of pending transactions, such as a point-of-sale transaction; 2) funds on hold in accordance with our funds availability policy; 3) our receipt of notice that a transaction will be presented or returned; or 4) our receipt of legal process relating to your Account. Please refer to the section below titled "Funds Availability" for availability of deposits. The Available Balance is used to determine whether to authorize, pay, or return transactions.
“Card” means the Pivot Card Physical Card or Virtual Card that may be used to access the funds deposited in your Account as further described in the section titled “Using Your Card.”
